By accessing or using the My Trade Hub platform (“MTH”, “we”, “us”, or “our”), including our website at mth.com.au and any associated services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the platform.
MTH is operated by My Trade Hub Pty Ltd, an Australian company. These Terms are governed by the laws of Australia.
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our services. By registering an account, you represent that you meet these requirements.
If you are registering on behalf of a company or organisation, you represent that you have the authority to bind that entity to these Terms.

Certain features of the platform may require a paid subscription. By subscribing to a paid plan, you agree to pay the fees as described on our pricing page. Fees are quoted in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.
We may change our fees with 30 days' written notice. Continued use of paid features after a fee change constitutes acceptance of the new fees.
The MTH platform, including its design, code, features, and branding, is owned by My Trade Hub Pty Ltd and is protected by Australian and international intellectual property laws.
You retain ownership of any content you upload to the platform (documents, images, tender information). By uploading content, you grant us a limited licence to store, process, and display that content as necessary to provide our services.
Our platform uses artificial intelligence to assist with estimation, document analysis, and other functions. While we strive for accuracy, AI-generated content is provided as a tool to assist your decision-making and should not be relied upon as the sole basis for any business decision.
You are responsible for reviewing and verifying all AI-generated estimates, suggestions, and outputs before use.
To the maximum extent permitted by Australian Consumer Law, MTH's liability for any claim arising out of or in connection with these Terms or the use of the platform is limited to the amount you have paid us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by agreement.
Your use of the platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988.
You may close your account at any time by contacting us. We may suspend or terminate your access to the platform if you breach these Terms, with or without notice depending on the severity of the breach.
Upon termination, your right to use the platform ceases immediately. We will retain your data in accordance with our Privacy Policy and applicable law.
Any dispute arising out of or in connection with these Terms will first be subject to good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre.
We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Your continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
